Terms & Conditions
The following terms and conditions of sale are applicable to all sales of Products concluded remotely through the Website intended for delivery to both local and overseas. These terms and conditions of sale may be modified and updated at any time; the conditions applicable to the order of a Product by a customer are those in force on the day the order is placed.
Description of Products
We will take all reasonable care to ensure that all details, descriptions, images and prices of Products appearing on the Website are correct at the time when the relevant information was entered into the system. Although we aim to keep the website as up to date as possible, the information including product descriptions and price appearing on the website at a particular time may not always reflect the position exactly at the moment you place an order.
Placing an order and forming a Contract
When you place an online order for the Products you have put in your “shopping cart” you are:
Offering to buy them at the price and on the terms in this website; and
warranting that you are legally capable of entering into binding contracts, are at least 18 years old and have legal capacity and be the holder of a bank card or account as defined in Payment Condition below.
We will send you an e-mail acknowledging that we have received your order, but please note that this does not mean that your order has been accepted. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product(s) has been prepared for shipment (the Despatch Confirmation) or processed (for Self Collection). The contract between us (Contract) will only be formed when we send you the Despatch Confirmation to confirm that we have prepared and scheduled your Product(s) for shipment; or that your Product(s) is ready for collection in-store. If, despite the vigilance of the Company, the Product(s) ordered are no longer available, we shall inform you by any means at our discretion (e.g. telephone call or e-mail) at the earliest opportunity and will refund any amount invoiced to you by crediting the refund to your original form of payment. The Company cannot under any circumstances be held liable for any disruption to stock or the lack of availability of Articles.
The Contract will relate only to those Product(s) whose despatch we have confirmed in the Despatch Confirmation. We will not be obliged to supply any other Products which may have been part of your order until the dispatch of such Products has been confirmed in a separate Despatch Confirmation.
We will not accept orders:
- If we do not have stock available to send to you at the time shown in this website.
- If you are under 18 years old.
- If you cannot, or are not willing to, pay by one of the types of payment methods listed in this website or if your card issuer will not confirm the payment.
- If you cannot, or are not willing to, pay the shipping charges when your shipping address falls under the list of affected destination countries here.
- If there has been a dispute relating to payment for a previous order
- We reserve the right to choose not to accept any order.
Prices, Taxes and Shipping Charges (If Any)
The prices of the Product(s) displayed on the Website are given in Singapore Dollars and are inclusive of GST; they do not include shipping charges and other taxes, unless otherwise indicated. The prices invoiced are those applicable on the date of the order validation.
The shipping charges pertaining to the shipping of the Product(s) only occurs when your shipping address falls under the list of affected destination countries marked as remote areas, restricted or high-risk countries. The Company reserves the right to alter the prices of the Product(s) and the shipping charges at any time and without prior notice.
Payment Conditions
Purchases made by you may only be settled by bank card, direct funds transfer or “ShopBack”. The bank cards accepted are Visa, Mastercard, American Express and UnionPay. The order will not be processed if it proves impossible to debit the amount for any reason whatsoever (payment stopped, declined by the card provider, etc.). If the card provider declines authorisation to debit the card, it is your responsibility to get in contact with the card provider to resolve the situation and revert to us if necessary. The order will also not be processed if the direct funds transfer is unsuccessful (unable to use the Singapore Quick Response Code (SGQR), insufficient funds, etc.); or if the “ShopBack” transaction is unsuccessful (expiration, insufficient funds, etc). Under no circumstances may the Company be held liable for any delays or failure to deliver.
Delivery
The Product(s) purchased will be shipped to the delivery address given during the order process. Under no circumstances may delivery be made to hotels or to a post office box. Delivery will require the signature of yours, or of the third-party beneficiary (over the age of eighteen) designated by you. Signature will be recorded in DHL system as an electronic proof of delivery (POD). You or your third-party beneficiary must ensure that they are present during the stated delivery window. If not present, a missed delivery notice will be left for you, who will have to wait for a subsequent delivery to be made the next working day or contact the shipping company directly to schedule delivery at a later date. We also offer the option to have the Product(s) self collected at any of our All Watches boutique.
Once the package has been shipped, you will receive an e-mail to confirm dispatch containing a tracking link to enable the progress of the shipment to be monitored. We will take all necessary steps within our control to ensure that the shipping company delivers within the lead times given when ordering. If, when delivered, the external appearance of the package suggests it is damaged, the customer may refuse to accept delivery and state his or her reasons for doing so to the shipping company; you must inform us by e-mail at info@allwatches.com.sg. For self collection orders, once the Product(s) is ready for collection, you will receive an e-mail with the collection details.
Each package delivered by All Watches contains: – the Product(s) ordered – the corresponding accessories, where applicable – the warranty card, the technical specifications and the user manual for the watches. We will be responsible for your Product(s) while in transit, until the moment of delivery (DHL Tracking Status marked as “Delivered”). It is at this point that liability is transferred from us to you.
Consumer Rights
To cancel a Contract, you must inform us in writing.
You have the right of cancellation, with a valid reason (e.g. Product(s) is faulty upon receipt or wrong item delivered), within seven (7) days of receipt of the Product(s). You must also return the Product(s) to us immediately, in the same condition in which you received them (in their original packaging, in perfect condition, complete (accessories, manual, warranty) and accompanied by a copy of the delivery slip), and at your own cost and risk. You have a legal obligation to take reasonable care of the Product(s) while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.
Product(s) ordered on the site www.allwatches.com.sg must be returned to the following address: All Watches Pte. Ltd., 2 Sims Close, #06-02 Gemini@Sims, Singapore 387298. Only Product(s) ordered from the All Watches online may be returned to this address. Under no circumstances may Product(s) purchased in the boutique be returned to this address.
You will not have any right to cancel a Contract for the supply of any Product(s) that has been engraved, personalised or altered at your request, or which you have pre-ordered.
Compliance
You must ensure that the Product(s) which have been delivered to you match the order. Should the Product(s) delivered not comply with the order,you must notify us at the earliest opportunity by sending an e-mail to info@allwatches.com.sg stating why the Product(s) does not comply with the order and, after approval has been granted by us, return the Product(s) in question in their original packaging, in perfect condition, complete (accessories, manual, warranty, etc.) to the following address: All Watches Pte. Ltd., 2 Sims Close, #06-02 Gemini@Sims, Singapore 387298. The Product(s) must be returned by recorded delivery, or by any other method guaranteeing a definite date and which can be tracked. If it is not possible to exchange the returned Product(s), the invoiced price of the returned non-compliant Product(s) will be refunded, by crediting the refund to your original form of payment, at the latest within thirty days of receipt of the returned Product(s).
Retention Of Title
We retain ownership of the Product(s) order and delivered until full payment of the purchase price and any delivery charges has been received, by which it is meant that all funds have been cleared by us. If payment of all or some of the amount is not received, we may, without any formal prior notice, claim back the Product(s) which have been delivered to you. The customer assumes all risks relating to the delivered Product(s) (specifically loss, theft or damage) from the time in which the Product(s) has been delivered.
Events outside our Control
Our performance under any Contract is deemed to be suspended for the period that circumstances outside our control continue or a force majeure event occur, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring such circumstances to a close or to find a solution by which our obligations under the Contract may be performed despite the said circumstances outside our control. The following is a non-exhaustive list of such events: war, riot, insurrection, social unrest, disruptions to telecommunications, computer breakdowns or serious impact on the security and integrity of the Internet or strikes of any nature.
Waiver
If we fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these Terms & Conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.
A waiver by us of any default shall not constitute a waiver of any subsequent default.
No waiver by us of any of these Terms & Conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.
Disputes – Applicable Law
These terms and conditions of sale are governed by Singapore law and will be interpreted in accordance with its provisions. Singapore courts have exclusive jurisdiction in the event of a dispute.
